论合同法对格式条款的规制

格式条款是统一合同法与原三大合同法相比较新增加的内容。格式条款顺应了社会生活发展和民商法价值取向的需要，但它同民商法其他原则的背离及与其他法律制度的冲突却愈演愈烈，并由此引起的司法纠纷也日渐增多，对此法律界应予以关注。

On the Regulation of Formula Articles by Contract Law

Formula Articles are newly added contents to the original contract laws, and as a contractual system that goes along with the social development, they are an entity of the coexistent assets and liabilities. Their assets lie primarily in the satisfaction of the social life and the requirements of the civil mercantile laws, and their liabilities in their increasing conflict against other related laws and the consequent legal cases resulting from them. The author therefore thinks it necessary that the law enforcement agent pay due attention to this problem.
