| 摘 要： | 林权虽然不是一个规范的法律概念，但已被我国的林业政策和实务部门普遍接受。现行法上的林权制度，具体包括林地所有权、林地使用权、森林或林木所有权以及森林或林木使用权，虽然其中有些权利的法律性质或权利内容在物权法中尚未明确，但是应当认定这些权利均属于物权，具有物权的法律效力，可以适用或类推适用《物权法》的相关规定。

| Abstract: | Although the concept of forestry right is not a formal legal concept in current Chinese legislations,it is widely used in Chinese forestry policy by the government.The forestry right in Chinese current laws includes 4 different kinds of rights: ownership of forest land,usufruct of forest land,ownership of timber or forest and usufruct of timber or forest.All of these 4 rights belong to real right and have the legal effect of real right.Therefore, the regulations of Real Right Law can be applied to these 4 r... |
