政务处分法规制我国行政垄断的适用性

滥用行政权力,实施排除、限制竞争等行为属于行政垄断,它严重地影响我国社会主义市场经济持续健康发展。党和国家强调要加强对行政垄断的规制并制定了《中华人民共和国反垄断法》,意在从法律层面上予以根除。但该法在实践过程中,却逐渐暴露出对行政垄断责任追究的执法权限配置不科学等问题,同时,学界针对完善行政垄断规制制度的研究与建议,又大多自限在反垄断法法域中,讨论热烈却没能解决问题。有鉴于此,为突破我国行政垄断规制建设的局限,完善其不科学的配置,本文基于《中华人民共和国公职人员政务处分法》的适用来规制我国行政垄断的主张,分析了规制法理、规制思路、规制动力,分析了政务处分法的主体、行为、责任等具体规制制度对行政垄断的适用性,指出政务处分法承接了反垄断法对行政垄断的行政规制思路,完成了纪律责任向法律责任的具体转变,整合党纪、监察、行政,形成合力,为规制行政垄断提供了有力的法律适用基础与条件,并极具现实的生命力,从而阐明政务处分法在规制我国行政垄断方面具有特定的适用性。

The Applicability of Law on Governmental Sanctions for Public Employees Regulating the Administrative Monopoly

The article puts forward the proposition of regulating the administrative momopoly with the law of Governmental Sanctions for Public Employees of People's Republic of China,analyzes the theory,idea,initiative of the regulation and the applicability of regulating the administrative momopoly with the specific rules on subject,action,responsibility of the law of Governmental Sanctions for Public Employees.The above mentioned the law of Governmental Sanctions absorbs the idea from the Antitrust Law of regulating the administrative momopoly,converts the disciplinary liability of the CPC into the legal liability,integrates the discipline of the CPC,supervisory,administration into the join forces.The law of Governmental Sanctions is really practical for providing the stable basis and useful conditon of regulating the administrative momopoly.All the foregoing statement proves that the special applicability of regulating the administrative momopoly with the law of Governmental Sanctions for Public Employees.
