| 摘 要： | 现代化是历史演进的大势所趋，也是中国正在经历着的发展过程。制度现代化，也即本文所言之法治，是这一进程的重要一环。法治体现了现代化进程中的人文价值关怀与效率追求。法治状态下的法律制度自身应当具有统一性、稳定性、可对话性和可交流性、正当程序性以及可诉性等品质。

| Abstract: | The modernization is the tendency of history evolution,and it's also the progress undergoing in China.The modernization of system,just as the rule of law that we will discuss in this article,is the most important part in this development.The rule of law embodies the humanity and the pursuit of efficiency during this process.Under the condition of the rule of law,the legal system should be of these characteristics unity,stability,communicability,proper procedure and litigation. |
