论非法演绎作品的保护

非法演绎作品的保护问题 ,目前在实践中和在理论界仍有争论。文章从对非法演绎作品的界定入手 ,并通过具体案例的分析及学理上的探讨 ,认为对于非法演绎作品的保护 ,只有通过著作权法的有条件保护和民法不当得利制度的补充保护 ,方能体现著作权法的立法宗旨和对权利保护的周详

Dicussicen on protection of illegal deduction works

At present ,there are still a lot of debates on the protection of the illegal deduction works, both in practice and in theory. This paper makes an analysis of the definition of the illegal deduction works .Then by the analysis of a specific case and the legal theories, this paper gives the view: the illegal deduction works should be protected by the Intellectual Property Law under some conditions. Meanwhile ,the Civil Law should gives the supplement protection. Only by this way, the legitimate rights of the illegal deduction works can be thoroughly protected.
