国际法视野下少数人语言权利保护研究

当前，少数人语言对于维持和发展少数人群体特征的作用毋庸置疑，越来越多的国际法律文件和区域法律文件就保护并发展少数人的语言权利予以规定。这些规定是否已经落实，或者在实施的过程中还存在哪些障碍，都直接关系着少数人权利的实现、国家及区域的安全构建以及文化多样性的实现等诸多问题，有必要对少数人语言权利的具体保护实践开展研究。只有了解少数人语言在行政领域、传媒领域以及诉讼领域的具体使用和保护情况，才能结合已有的国际法律文件，提出进一步完善和发展这些保护实践的建议。

Protection of linguistic rights of ethnic minority groups under the international law

Currently, the function of minority languages in maintaining and developing minority characteristics is universally acknowledged. More and more international legal documents and regional documents have clear terms and regulations for the protection and development of linguistic rights of ethnic minority groups. The success or failure in the implementation of these terms and regulations is directly related to the implementation of the rights of ethnic minorities, the national and regional security and the realization of cultural diversity, which deserves further studies. The paper discusses the application and protection of ethnic minority languages in the domains of administration, media and litigation, and gives some suggestions on their improvement with a consideration of the relevant international documents.
