刑事被害人国家补偿制度论纲

在现实中,一些被害人在受到犯罪的侵害后,因未得到任何赔偿,从而使生活陷入困境之中.虽然侵害的结果是由犯罪人造成的,但是,国家对公民权益保护的欠缺也是其原因之一.因此,国家应给予被害人一定的补偿,以保障他们的基本生活.然而,目前我国尚无刑事被害人国家补偿的专门立法.鉴于此,我国可以从基本理论入手,分析借鉴其他国家相关的理论、立法及司法经验,建构我国的刑事被害人国家补偿制度,以更好地维护刑事被害人的合法权益.
