| 摘 要： | 农村建设用地流转长期以来不规范，管理较为混乱，不仅使规划指标屡屡突破，而且正常的市场秩序也受到干扰。党的十七届三中全会通过的《中共中央关于推进农村改革发展若干重大问题的决定》为今后农村建设用地流转指明了方向。本文从土地法学的角度，分析了建立城乡统一的建设用地市场的法律基础，并探讨了为建立农村建设用地市场需进一步加强的法律及制度建设。
