林事纠纷司法解决机制的问题与重构

林事纠纷包括林权纠纷和森林资源保护纠纷。林事纠纷的特点决定其司法救济应当有特殊的制度安排。目前我国林事纠纷的司法解决机制存在诸多问题,影响了林事纠纷的公正有效解决。林事纠纷司法解决机制重构的方向是司法专门化,建立不同于森林法院、林业审判庭的环境法院,以应对林事纠纷对于程序的特殊要求,减轻普通法院的工作压力,满足特殊价值保护的需要。新型林事纠纷司法解决机制的基本内容体现为：组织结构的相互配合,管辖范围的一体化,程序机制的一体化和政策形成机能的发挥。

Forestry disputes include the forest property rights disputes and the forest resource protection disputes.The characteristics of forestry disputes decide that its judicial relief should have special institutional arrangements.At present,the judicial settlement mechanism of forestry disputes in China has many problems,which affect the fairness and efficiency of resolution of forestry disputes.The direction of reconstruction about judicial settlement mechanism of forestry disputes is judicial specialization,which covers the establishment of environmental courts to satisfy the special requirements forest disputes for the process,to reduce the work pressure of the ordinary courts,to meet the needs of special interest protection.The basic elements of new judicial settlement mechanism of forestry disputes are embodied in the mutual coordination of organizational structure,integration of the jurisdiction,integration of procedures mechanism and policy formation function to play.
