| 摘 要： | 民族自治地方获得利益补偿的权利在民族区域自治法及其他相关法律中有相关的规定,该项权利因补偿资源开发给民族自治地方带来不利影响、国家的矿产资源所有权与民族自治地方对土地的权利之问的冲突以及民族自治地方为国家的生态平衡和环境保护付出的牺牲而设立。该项权利应在借鉴国外经验的基础上进一步完善,主要包括扩大利益补偿制度的适用范围,完善利益补偿制度的实施机制和配套措施等。

| Abstract: | The rights on interest compensation in autonomies are regulated in Autonomy Law in National Regions and other related laws.Such rights are constituted to compensate the disadvantage of autonomies caused by resource exploitation and conflicts between the country miner ownership and local government's autonomy rights,and sacrifice national regions undertake to contribute to the eco- logical and environmental balance.Such rights should be developed further after studying the ad- vanced experience abroad,including expanding the interest compensation extension,improving the implementing mechanism and consummating accessorial laws. |
