论立案功能之平衡

刑事诉讼的启动程序具有两大基本功能:输入功能和过滤功能。在我国,立案的输入功能存在不足,而基于人权保障的理由,立案的过滤功能却得到过分强调。立法和司法实践存在的脱节使这一程序的改革成为必然,对其功能的定位也必须重新认识,要淡化其案件过滤功能和由此产生的人权保障功能。

On the Balance Between Case-registering Functions

The starting procedure of criminal suit should have two basic functions.One is the importing function,the other is the filtering function.In China,the importing function is imperfect and the filtering function has been emphasized by the reason of protecting human rights.The legislation has divorced from practice and the procedure must be reformed.The position of the case-registering functions must be fixed in another way.The filtering function and the protecting human rights function should be drawn back.
