非典型作品的著作权保护探究

随着新时代社会物质文化的快速发展,人们陆续就音乐喷泉、烟花、插花、武术表演等非典型作品的著作权保护展开讨论,甚至已有部分客体涉及诉讼,这就要求研究者厘清著作权法所规定的“作品”的概念和界定,明确非典型作品的特点与保护意义,才能探寻非典型作品著作权保护的路径。因此,当前应通过法律解释的方法并结合司法审判实例来探究非典型作品著作权的保护路径。
