论宪法发展研究的文化取向

中国宪法学在谋求理论创新的过程中,采取站在更高层面的、具有宏观指导意义的文化的视角是推动宪法发展的极为重要的理论方法论。宪法发展目标的设定、宪法精神的养成、宪法基础的生活化都提示人们要关注宪法发展的文化背景问题。从实证的角度看,"文化多元与宪政实现"并不是一个保守的命题,而是主张在全球化的背景下,充分考虑中国社会的认同度和支撑度的问题,这更有利于我们对当代中国宪政制度发展的创新性研究。

On Cultural Analysis of the Study of Constitutional Progress

For the progress of Chinese Constitutional Law, cultural analysis is a very important methodology. The problem, such as to make sure the constitutional progress goal, to nurture the constitutional spirit and to make the basis of constitution lively, giving us the hint our that we should attach importance to the cultural background of constitutional law's development. From the opinion of demonstration, "realization of multi culture and constitutional government come true" isn't a conservative idea, the article argues, under the background of globalization. Thinking over Chinese society's self-identity and level of support, it will be propitious to the innovative study of Chinese constitutional government.
