业主自治的基础法律问题研究

从业主、业主自治基本理论出发，确定业主与物业管理企业之间的委托关系；从业主自治的法理基础来说，业主自治是以建筑物区分所有权的共有权为基础的，所以笔者以建筑物区分所有权为基础，对业主自治存在的法理基础进行分析，总结业主自治的几个基本原则，即效率原则、公开原则、公平原则和约束力原则，为业主自治的具体操作提供理论依据。
