加强司法主体的道德建设与制度规约：实现司法公正的重要保障

解决影响司法公正的突出问题,是深化我国司法体制和工作机制改革的重要内容。司法主体司法行为的理性化又是公正司法的基本前提。道德建设是实现司法主体司法行为理性化的内在要求;制度规约是实现司法主体司法行为理性化的外在条件。由此决定了我国在培养司法主体司法行为理性化的过程中,必须把加强道德建设与强化制度规约有机地结合起来,并作为其重要保障。

On Strengthening the Morality Building and System Regulation of Judicial Subjects: the Important Guarantee for Judicial Justice

To resolve the outstanding problems that affect judicial justice is an important part in deepening the reform of judicature system and working mechanism in our country. The rationality of judicial behaviors of judicial subjects is the precondition to justness in judicatory. Morality building is the inner demand of rationality of judicial behaviors of judicial subjects while system regulation is the external condition. All these determine that strengthening morality building and consolidating system regulation of judicial subjects should be harmoniously combined in the process of cultivating judicial behaviors of judicial subjects for this is the important guarantee for morality building and system regulation.
