| 摘 要： | 农业生态补偿制度是生态补偿制度体系的重要组成部分。从历史上看,构建农业生态补偿是对农业的特别牺牲予以补偿,恢复社会成员之间义务负担平等的需要;从现实来看,是促进农业生态环境保护和可持续利用农业环境资源的需要。我国现行农业生态补偿在立法上存在空白问题,在实施中缺乏可操作性。农业生态补偿立法应在整体的生态补偿立法中和新农村建设中予以完善。在具体实施过程中,应健全农业生态补偿的组织管理体系和财政转移支付制度和投融资制度;在具体实施方式上,应完善"计划 项目 协议"补偿形式,提高补偿资金利用效率。

| Abstract: | Ecological Compensation System of Agriculture(ECSA) is a vital part to ecological compensation mechanism.Constructing ECSA is necessary to compensating the special sacrifice of agriculture and farmers and recovering the fair obligation load among social members from the historical perspective,and this,at the same time,can promote the ecological environmental protection and sustain the utilization of agricultural resources.There exist some legislative vacancy and deficiency of workability.The legislation of ECSA should be taken as an integral part of ecological compensation mechanism and new rural construction.We should construct and perfect the organizational management system,along with the financial transfer payment system and the investment and financing system."Plan project agreement"should be perfected in the specific way of implementing so as to improve the capital efficiency. |
