| 摘 要： | 宣誓在古代西方的诉讼中普遍存在.现代西方国家的诉讼程序虽然淡化了其宗教色彩,却保留了对伪誓者的惩罚,强化了对宣誓者证词的甄别.所以,现代西方的宣誓制度并非仅是古代宣誓制度的形式上的遗存,而是有了重大改进和发展,更具有合理性和实用性.从现实需要出发,我国应积极借鉴该项制度,剥离它的神学外衣,引入它的实质内容,以弥补我国诉讼程序和执行程序中证明手段的不足.

| Abstract: | Swear was prevalent in litigation of ancient western countries. Modern swear rule weakens its previous religious sense, reserves its punishment to perjurers. It also strengthens the identification of witness. Instead of simply being the remains of ancient swear rule, modern rule is more rational and practical. Thus, we should introduce it to make up for the lack of attestation means in our litigation and enforcement procedures after uncovering its religious coat. |
