论侵害生命权之损害赔偿

对生命本身进行所谓的“命价赔偿”是比较古旧的生命侵权责任承担方式。在21世纪的今天,重新提出“命价赔偿”,以同样遇难却获得不同赔偿来推断出“同命不同价”的结论,是一种误导。死亡赔偿制度所采法理基础有继承主义和固有损害主义之分。当前中国的立法和司法实践采用了一种“改良”了的继承主义。个中不太成功的改良被视为“城乡二元歧视”的又一体现,招致了所谓“同命不同赔”的责难,有待改进。

On Restitution for Infringement of Right of Life

The means of shouldering the liability for one's infringement of others' rights of life underwent a long-time evolution in history.In the 21th century,it is misleading to propose "restitution for the damage of life-price" again,and then deduce the conclusion that "same lives have different prices" from the judicial practice that the same losses receive different compensations.The jurisprudent theory,on which the laws about restitution for death base,is divided into "inheritance system" and "innate injury system". Nowadays,Chinese legislation and judicial practice apply a kind of improved "inheritance system".Several unsuccessful improvements,treated as another embodiment of the discrimination against peasants,lead to the stormy blames about the phenomenon that "the same lives have different prices",therefore,this theory needs further improvement.
