| 摘 要： | 研究指出，我国目前出现了进城务工的农民工超龄化的现象，其合法权益得不到保障对社会劳动保障体制提出了新的挑战。高龄农民工中的部分超过退休年龄的农民工由于年龄的问题，在工地上的事故中遭受伤害后，合法权益往往得不到法律的有效全面保护。本文针对超龄农民工在务工过程中遭遇伤害的问题提出一些建议，并从法理上做出了解释。这对于维护超龄农民工的合法权益有重要的现实作用。

The rights protection of overage peasant-workers in the event of occupational injuries |

| Abstract: | With the problem of aging society,the phenomenon of overage peasant-workers appears. Its rights safe-guard faces new challenges to social labor security system. The legitimate rights and interests of part of the migrant workers of over the retirement age can often not get protection of the law after suffering injuries in an accident of the site. This paper studies on the problem of overage peasant-works when they suffering the occupational injury. It has the vital significance to safeguard the legitimate rights and interests of overage peasant-worker. |
