| 摘 要： | 特价机票使用限制条款的有效性应当根据《合同法》有关格式条款规定予以分析判断,既应充分保护消费者的合法权益,又应适当考虑承运人的运营成本与定价策略。承运人、消费者以及运输管理部门应从各自角度出发,共同努力避免与此相关的纠纷愈加复杂。

| Abstract: | The validity in limitation of tickets with discounted fares should be determined according to the standard terms of Contract Law. It should both protect consumers effectively and consider carrier＇s operat- ing cost and pricing strategy. Consumers, carriers, and transport authority should modify their knowledge or rules of policy to avoid further disputes. |
