| 摘 要： | 刑法第263条将"冒充军警人员抢劫"作为抢劫罪的加重情节予以规定,这必然影响罪刑相适应原则的实现。因此,在不违反罪刑法定原则的前提下,在司法实践中应当限制适用"冒充军警人员抢劫"这一规定。

| Abstract: | Article 263 in Criminal Law stipulates that the robbery by disguising as an armyman or policeman is an aggravated case of Crime of Robbery. It necessarily brings effects to the realization of the principle "Suit the punishment to the crime". It is held that under the condition of not violating the legally prescribed crime-punishment principle, the application of identifying crime of robbery by disguising as an armyman or policeman should be restricted in judicial practice. |
