类余额宝产品的相关法律问题研究--以经济法实质正义理念为视角

类余额宝产品作为新兴互联网金融产品，有着低风险、高收益、快速申购及赎回的特征，吸引了众多金融消费者的青睐。然而，类余额宝产品作为一个“新生儿”，在其内部交易过程中仍有着许多的法律漏洞。另一方面，对于创新事物“先发展后规范”的情况，相关监管部门对于类余额宝产品的外部监管也相对落后。因此，笔者试图以经济法理念中的实质正义理念为视角，分析类余额宝产品本身交易和外部监管的相关法律问题，用实质公平内容指导内部完善，用平等自由、理性秩序指导外部监管，以实质公平理念以更好的完善类余额宝产品，服务大众。

Research on legal issues of Yu'ebao & similar products---from the perspective of the concept of substantive justice in economic law

As emerging internet financial products ,Yu'ebao and similar products attracted many financial consumers with its low risk,high-yield,fast purchase and redemption features .However,being a “newborn”,there still exist a lot of loopholes in its internal transactions .On the other hand ,in the case of “developing first ,regulating later” for innovative things ,the external regulatory from relevant regulatory authorities for Yu'ebao and similar products is rela-tively backward .So ,the author tries to analyze the relevant legal issues about the transaction and external supervi-sion of Yu'ebao and similar products from the perspective of the concept of substantive justice in the economic law conception,use the content of substantive justice to guide internal improvement ,use equality,freedom and rational order to guide external supervision ,improve Yu'ebao and similar products with the concepts of substantive justice to serve the public .
