美国企业破产制度与银行破产制度比较

纵观全球，在银行破产问题上有两种立法例，一是普通法立法例，二是特别法立法例。前者以德国和英国为代表，他们的普通公司破产程序与银行破产程序都规定在普通破产法典中。后者以美国为代表。银行破产不适用普通破产法典的规定，而是用特别的银行破产法。通过对美国普通公司破产法和银行破产法的比较研究，可以了解普通公司破产与银行破产的不同，从而为我国制定银行破产法提供借鉴。
