论《民法典》新规在房地产业领域的法律适用

摘    要:《中华人民共和国民法典》于2021年1月1日起在我国施行,我国即将进入民法典时代。“盛世制法典,国运必兴隆。”结合《民法典》和其他法律法规、司法解释、部门规章的相关规定,围绕我国房地产业相关问题展开分析论述,着重分析了国有土地上房屋征收与补偿、建设用地使用权转让、在建建筑物抵押与担保物权的实现问题。结合法律、法规、规章的规定与实务中的实际做法,探讨房地产业在运行过程中应该注意的事项和风险的防范,突出法律对我国房地产业健康发展的规制作用。

On the application of the new regulations of the Civil Code in the field of real estate

Abstract:The Civil Code of the People''s Republic of China will enter into force on January 1, 2021, and China will soon enter the era of civil code. "The prosperity of the code, the prosperity of the country will be." Based on the civil Code, other laws and regulations, judicial interpretation, and relevant regulations of the department, this paper analyzes and discusses related problems in China''s real estate industry, focusing on the issues of the expropriation and compensation of houses on state-owned land, the transfer of the right to use construction land, and the realization of the mortgage and security right of buildings under construction. Combined with the provisions of laws, regulations and rules and the practical practice, this paper discusses the matters needing attention and the prevention of risks in the operation of the real estate industry, and highlights the regulatory role of laws in the healthy development of China''s real estate industry.
