| 摘 要： | 《刑法修正案(十一)(草案)》拟将高空抛物行为新增为“以危险方法危害公共安全”的犯罪行为类型,司法认定“以危险方法危害公共安全罪”的核心在于判断高空抛物行为是否具备“危险方法”和“危害公共安全”两大核心构成要件该当性。通过类型化分析高空抛物行为,发现既有法律手段足以规制该行为,刑事立法应保持谦抑性,无需新增条款加以规制。

| Abstract: | The Criminal Law Amendment (11)(draft) intends to add parabolic behavior at high altitude to the type of criminal act of "endangering public safety by dangerous method". The core of judicial determination of crime of endangering public safety by dangerous method lies in judging whether parabolic behavior at high altitude has two core elements:dangerous method and endangering public safety. Through the typological analysis of parabolic behavior at high altitude, it is found that the existing legal means are sufficient to regulate the behavior, and the criminal legislation should be modest and not regulated by new provisions. |
