人民监督员制度的立法思考

人民监督员制度试行至今,发挥了作用,显现出旺盛的生命力。由于这一制度目前仅依据最高人民检察院的有关规定来操作,学界和司法界不少人士认为应完善立法、确立人民监督员的法律地位。笔者以为,为人民监督员寻找更充分的法律依据是制度的发展方向,但前提是制度需经充分的司法实践,循序渐进,制度的立法设计应该与国家司法体制改革相协调,不能操之过急,待时机成熟后再提出立法较妥当。就此对当前立法存在的矛盾及完善人民监督员制度等问题进行探讨,以求为该制度立法奠定良好的立法基础,并提出立法的初步设想。

Thinking on the People's Supervisor System

The people＇s supervisor system has played an important role ever since it has been tried out. Given the fact that it can only be operated according to the related rules governed by the Supreme People＇s Procuratorate,various opinions of perfecting legislation and establishing lawful status of the supervisors are voiced out by scholars. It＇s pointed out that it is the right direction to seek more profound legal basis for the people＇s supervisors,which should be accordant with the reform of legal system. And some initial ideas of the present legislation eontradietions and perfecting the people＇s supervisor system are also put forward.
