| 摘 要： | 微软"黑屏"事件引起了广泛争议.从学理研究的角度出发,通过对微软"黑屏"行为和后果的分析,本文认为其行为超越知识产权的合理范围,违反正当的行政司法程序,侵害电脑用户的财产权和隐私利益,滥用知识产权及其市场支配地位,应当予以规制,并据此建议加强对此类行为的理论研究,为知识产权维权和其他利益的保护提供可靠的法律依据和程序规范.

| Abstract: | The event of Microsoft's blank screenhas caused widespread controversy.From the viewpoint of theoretical research and through analyzing the behavior and consequence of blank screen,this paper argues that its behavior should be regulated because it goes beyond the reasonable scope of intellectual property rights,violates the proper administrative and judicial process,injures the computer-users' property rights and privacy benefits,and abuses the intellectual property rights and its dominant market position.... |
