从合理性原则审视WTO保障措施的适用

合理性是政府运用保障措施的必然要求,是保障措施超越WTO自由贸易价值取向的产物,凸显了“合理性”在WTO保障措施问题上的重要性,并把政府适用WTO保障措施定位为一种国际间政府行为,从传统的政府行为合理性原则的视角,结合WTO争端解决机制确立“非违法之诉”对合理性的认定,把行政合理性原则对政府行为的要求应用到WTO保障措施的适用中,寻求我国政府合理适用WTO保障措施的解决方案。

Reflections on How the Chinese Government Should Properly Apply WTO Safeguard Measures: From the Perspective of Principle of Administrative Reasonableness

This paper elaborates on the relation between WTO safeguard measures and the value orientation of WTO free trade. It shows the importance of "administrative reasonableness" in WTO safeguard measures. It defines the government's application of WTO safeguard measures as a kind of international governmental behaviour. From the perspective of the traditional principle of administrative reasonableness , this paper shows how the requirement of the governmental behaviour prescribed in the principle of die administratiye reasonableness will be applied to WTO safeguard measures, and seeks how the Chinese government can apply properly the resolution of WTO safeguard measures.
