| 摘 要： | 我国土地征收补偿法律制度自2004年以来虽然日趋合理，但补偿原则、补偿制度和纠纷救济机制的缺漏．使得农民利益遭到极大的侵害，严重影响了农民的生存与发展空间。有必要对涉及土地征收补偿问题的宪法原则以及行政法、民法制度进行反思和完善，并对解决土地征收补偿纠纷的行政和司法救济机制提出完善建议。
