| 摘 要： | 中国人民历来就有伟大的创造精神,中国物华天宝,有着良好的天然创造条件,中国古代一直走在世界创造活动的前列,为世界创造活动的发展做出了巨大贡献。但1840年以后,中国的创造活动明显衰落,创造环境差是创造衰落的主要原因。创造环境由职位环境、成果环境与事务环境三部分构成,法律对此既有专门规定,也有原则性规定。当前中国普遍存在"内部规则、潜规则架空法律"的现象,好法律被坏的内部规则、潜规则架空,破坏了我国的创造环境。鉴于当前很多单位法定代表人都有"权大于法"的冲动,我们必须制定《中华人民共和国单位团体内部规则行政备案审查法》,依靠专门的机构来制衡专横,完成创造环境改良的重大使命。
