| 摘 要： | 洛克认为,人的生命、自由和财产权是人最基本的自然权利,不可让渡、不可剥夺、不可侵犯,保护自然权利是公共权力得以存在的前提。政府的公共权力源于人民在订立社会契约时的委托式授权,公共权力政治合法性的根源在于民众自愿的结合和人们自由地选择他们的统治者和政府形式。洛克反对霍布斯把统治者排除在社会契约的订立者之外的观点,认为国家是人民自由契约的产物,统治者也是缔约方,其统治合法性的维持依赖于对人民生命、自由和财产权的有效保护,当统治者违反契约时,人民就有权废除他,建立新政府。
