摘    要:随着我国步入风险社会,对于食品安全问题,旧有的立法规范及司法手段已难以应对。刑法作为社会保障的最后一道法律防线,要有效确保食品安全,首先应在刑法理念上作出转变:由罪责刑法转向安全刑法、由被动评价到提前介入、由个体本位到社会本位的全方位转型。其次,在法律条文具体规定方面,应密切《刑法》与《食品安全法》的法条衔接、完善食品安全保护的刑事立法、规范食品安全犯罪的刑事认定等。

Abstract:With China stepping into a risky society, the previous legislative stipulation and judicial means are inadequate in dealing with food safety problems. In order to effectively safeguard food safety, the criminal law, as the last legal defender for a society, should first change in its basic concepts, that is, from crime-oriented to safety-oriented criminal law, from passive judgment to previous intervention, and from individual to social orientation, etc.. Furthermore, for the specific stipulation of legal provisions, priorities should be given to the agreement of articles between Criminal Law and Food Safety Law, the criminal legislation for food safety, and the standard criminal identification of crimes concerning food safety.
