国际法研究的建构主义路径

从本源看,国际关系与国际法之间联系紧密;在学科发展上,国际关系理论与国际法学相互依托、互相促进.在晚近的国际关系理论中,建构主义与新现实主义、新自由主义构成三足鼎立之势.建构主义理论与国际法学研究形成了有机互动.一方面,在建构主义的理论建构中,来自国际法的理论与实践给予了重要启发;另一方面,立足于反思主义认识论的建构主义理论思路,又从本体论与方法论等方面为国际法研究打开了一条全新的分析路径.

The Constructivist Approach to the Study of International Law

International law and international relations are closely linked in origin and studies of these two disciplines are interdependent and mutually beneficial. In recent theorization about international relations, three equally strong approaches have been proposed, i.e. constructivism, neo-realism and neo-liberalism. This paper argues that the theory of constructivism has enjoyed an organic interaction with the study of international law. On the one hand, scholars have drawn upon, and have been inspired by, the theory and practice of international law in their efforts to theorize constructivism. On the other hand, the constructivist approach which is based on reflective epistemology has proved to be a brand-new way of analysis in the study of international law in both ontological and methodological terms.
