| 摘 要： | ICSID是国际投资法领域中最为重要的争端解决机制之一.ICISD仲裁规则中规定了一项仲裁监督规则即仲裁裁决的撤销,该项制度对于实现仲裁的公正价值有着非常重要的作用,但在ICSID仲裁实践中却表现出了对仲裁效率价值的违反.公正和效率都是仲裁所追求的基本价值基础,二者在仲裁的价值体系中居于核心地位.不能因为公正而忽视了仲裁的效率价值,也不能因为效率而忽视仲裁的公正价值.因此,必须纠正ICSID仲裁裁决撤销制度对于仲裁效率价值的违反,可以从这几个方面做起:第一,以公平和效率并重作为其价值基础;第二,从具体制度方面改正ICSID仲裁裁决制度以实现仲裁的公正和效率并重.
