| 摘 要： | 随着我国经济的发展,个人拥有的财产越来越多,自然人死后其遗产状况也越来越复杂,侵害遗产债权人利益的行为时有发生.国外继承法对遗产债务的清偿问题用大量条文详细地加以规范,使之有序运行.而我国继承立法对遗产债务的处理仅有原则规定,司法解释也很少涉及.缺乏完善的遗产债务清偿制度,不仅使遗产债权人和继承人没有有力的法律手段保护自己的利益,而且司法机关在面临越来越多、越来越复杂的此类案件时也无法律依据可以遵循.遗产债务清偿问题已经不容忽视,对此进行全方位的研究具有重要的现实意义和理论价值.
