| 摘 要： | 众所周知,美国属于判例法国家,但是多数国内学者对于判例法的认识,往往停留在较为粗浅的层面。本文主要从判例法的含义、类型、表现形式,判例法的基本原则、法律方法、法律地位,以及判例法与制定法的关系入手,对美国判例法的运作机制进行较为深入的探讨。
