| 摘 要： | 研究探索金融背景下的金融法制的完善问题应该说是世界性难题，也是我国在完善资本市场、金融市场过程中的重要课题。长期以来法律缺乏对金融技术与制度创新保持协调发展的规范是酿成危机的关键性因素。国际金融危机警示我们，必须依法强化对金融创新风险的防控，力求法律监管机制防范金融风险的全覆盖，只有提高法律风险防范能力，才能依法保障和促进我国经济长期、稳定、健康的发展。
