中国传统法律文化与现代西方法律发展趋势若干契合现象之探讨

中国传统法律文化内容庞杂,其中蕴藏着一些契合现代西方法律发展趋势的元素,但两者也仅仅只是暗合而已,西方法律的东方价值取向只是对其自身僵化的一种反动,是一种后现代的投射,实质上两者仅有相似的外形,其价值基础、精神气质和内容却迥异。建设社会主义法治国家,向西方学习和移植先进的法律制度和法律观念是主要的途径,传统法律文化中的“本土资源”并不能为我们提供充分有效的资源。

Discussion about the Phenomenon of China's Traditional Legal Culture Agrees with the Legal Development Trends of Modern West

The traditional legal culture in China is large and jumbled in content, among which contain some elements that agree with the legal development trend of modern west. But they just agree without prior consultation,only a reactionary to its own rigid of the western law. The eastern value orientation of the western law is the modern throwing after one kind. They only have a similar appearance in fact, but the value foundation, spiritual makings and contents are different. Building the socialist country ruled of law, it is the main ways to learn from the west and transplant the advanced legal system and legal idea, because resources of native country in traditional legal culture cannot offer abundant and effective resources to us.
