中国土地征用制度中农户产权残缺分析

本文以中国土地征用制度中关于农户产权残缺的具体分析为基础,说明了引起农户产权残缺的主要原因是政府和农村集体在征地过程中角色错位,农村土地所有权主体缺失以及缺乏维护和保障农户土地权益的法律法规,认为当前农户土地产权残缺严重损害了征地农户的土地收益,结合新制度经济学和产权经济学的核心内容,最后指出从改革土地产权制度、规范政府行为和建立司法救济制度角度解决农户产权残缺这一问题。

The Analysis on Scarce of Property Right for Households in the Institution of Land Requisition of China

The basement of this paper is the analysis of the scarce of property right of households in China in land requisition.The author implicates the causes of the scarce of property right for households from three dimensions. One is the wrong rules of government and rural collective in land requisition. The other is no true owners of rual land. And another is few laws and institutions to guarantee and protect the land revenues for households. All of this approves the true thing that the land revenues of the households land required are deeply damaged in the result of the scarce of property right. Finally the countermeasures on the issue are given.They are the innovation of land property right institution,regulate the behavior of governnment,and build laws.
