农村离婚诉讼中的抚育费问题之研究

在当前我国农村离婚案件的审判中,对有关抚育费问题的审判标准及司法解释还存在着规定过粗、可操作性不强等问题,不符合当前我国农村的发展实际.因此需要进一步完善相关法规,充分考虑子女的实际生活需要和父母的实际支付能力,从生活费、医疗费和教育费等方面来计算抚育费,采取定期给付、一次性给付和以物折抵等方式支付,这样更有利于保护农村离异家庭子女的合法权益.

On the Child-Support Payment in Divorce Proceedings in Rural Area

There are problems in rural divorce proceedings that the legal provision and explanation on child-support payment are too simple and hard to judge,which is not fit for the rural area practice.So it is urgent to perfect relevant provisions,fully consider the children's actual needs and parents' ability to pay,include the cost of living,fee-for-service and educational expense in child-support payment,take the ways such as to pay a fixed amount at regular intervals,one-off payment,to pay by things and so on.It will protect the children's legal rights in rural divorced family.
