论我国检察机关量刑建议的功能及其实现

检察机关量刑建议是量刑规范化改革的一个重要环节。量刑建议有五大功能，即引导侦查机关取证活动，防范滥捕，扩展被告人的辩护权，制约法官量刑的裁量权，促进量刑向精细化方向发展，促进量刑从对行为关注转变为对行为人的关注，发展刑事诉讼中的合作协商精神。量刑证据的完整度和评估方式的科学性是影响我国量刑建议实质化发展的两个关键因素，应当强化检察机关对量刑证据资料的收集责任，构筑科学的量刑评估流程控制。

A Discussion on Function of Sentencing Proposal and its Implementation in China

Sentencing proposal is of great significance to establish standard sentencing procedure.It has five functions,namely,to guide the investigation activity,extend the rights to defend,restrict discretion of the judge,promote the development of sentencing from standardization to the refinement,realize sentencing atten-tion from behavior to perpetrator,and develop the cooperation consultation spirit in criminal proceedings.Integ-rity of sentencing evidence collection and scientific sentencing evaluation are two key factors which are restric-ting the development of sentencing proposal.Responsibility of sentencing evidence data collection should be strengthened and sentencing evaluation process control should be scientifically constructed.
