中国外资准入法律再审视

随着中国外资法从以外资经营阶段为管理重心向以外资准入阶段为管理重心的转型和中国加入W TO过渡期的结束,外资准入的深度和广度将会直接影响中国的经济发展和经济安全。完善外资准入立法,尤其是加大外资向中西部投资的优惠,同时防止由于地方恶性竞争而扭曲立法,是中国外资准入立法应当关注的问题。

Analysis of the Chinese Law on the Admittance of Foreign Capital

With the transition of Chinese law on foreign capital from management mode with the management of foreign capital as the focus to that focused on foreign capital admission and the end of chinese entry to WTO,the depth and width of foreign capital admittance will have a direct influence on Chinese economic development and security.Therefore,it is a great concern to perfect the legislation on foreign capital admission and especially increase the investment favor of foreign investment to the West of China and at the same time to avoid improper legislation due to the local malignant competition.
