对商品房预售中若干问题的分析

摘    要:居民个人购买商品房的数量在快速增加,但由于购买者普遍缺乏应有的法律知识,开发商在预售经营中存在诸多缺乏规范的问题,致使商品房在预售过程中经常出现纠纷。针对商品房预售过程中出现的几个热点问题,如不可抗力的确认,商品房销售面积、分摊的公用建筑面积的确认,商品房预售之预告登记手续的办理等进行了分析,提出了规范商品房预售经营,消除预售商品房纠纷的相关建议和具体措施。

Abstract:Recently the amount of houses sold in advance is increasing, but people who buy them are ignorant of the laws about real estate. Meanwhile, there are no pertinent standard rules to regulate the sales of houses; consequently, many disputes arise in the preselling of houses. Some of the key problems in the pr-eselling of houses are analyzed in this paper, such as the confirmation of unexpected forces, the confirmation of sold area of houses and sharing area of public construction, and the registration of houses sold in advance. Besides, suggestions and measures are put forward to regulate the preselling of houses and avoid disputes therein.
