论建设立法的完善与发展

本文通过对我国建设法规的发展历程、现行建设法规体系及实践情况的研究、分析得出 结论：通过二十余年的努力，我国的建设法规体系已初步具备科学化、系统化，取得较大成就。随着改 革开放的深入和中国加入ＷＴＯ，建设法规体系会相应作出调整，进一步与国际接轨，适应国际条约 和国际惯例。我国立足本国国情，借鉴外国立法经验，努力完善建设法规是必然的。主张应强调建设 立法的超前性；建设立法应进行监督；在立法中明确政府的法律地位至关重要。

Research on Development and Perfection of Legislation

In this treatise, it is concluded by researching and analyzing the course of the development of legislation and the Chinese present legislation system and its practice, and through more than twenty years' endeavor, Chinese legislation system has preliminarily become scientific, systematized and has made great achievements. With the Reform and Open Door policy going further and the joining in WTO, Chincse legisla- tion system will adjust itself correspondingly to further conform to the international practice, and adapt itself to international treaties and practice. In the author's view, it is necessary for China to endeavor to improve the legislation by basing itself upon domestic conditions and using the experiences of other countries as refer- ence. This paper suggests that the prediction of legislation should be stressed, that legislation should be su- pervised, and it is very critical to define the status of government in legislation.
