| 摘 要： | 宋代处于我国古代社会商品经济的繁荣阶段,交易普遍契约化,是两宋法制的最大特色。为了保障契约的履行,宋代的法律有很多的强制性的规定,这些措施有力的保障了债权人的利益,维护了正常的社会经济活动,对于宋代商品经济的发展起到了推动作用。

| Abstract: | The commercial economy in Song Dynasty made the creditor's rights and debts a wide scope.To keep the contract's performance,the legal regulation on contract in Song Dynasty regulated the form of contract,the guarantee system and substitutive system.The performance of contract was executed forcibly by the government.The punish ment for brearing the contract in Song Dynasty egulated the criminal sanction and economic sanction.All these meansure were efficient in safeguarding the creditor's rights,maintaining the normal socioeconomic activities. |
