德日原因自由行为理论研究

原因自由行为的现有理论成果可以说都存在于大陆法系的学说之中。所以本文通过介绍日本、德国的各种学说,对国外现有理论进行分析,揭开原因自由行为的矛盾本质,进而指出,对原因行为和结果行为的划分只是时间上的划分,作为刑法评价对象的只能是一个整体行为,由此观点出发展开自己的原因自由行为理论。
