| 摘 要： | 我国检察机关具有权能多元化和刑事诉讼全程参与的独特属性,检察机关在非法证据排除规则的具体适用过程中应该而且也能够发挥更大的作用。对检察机关在审前阶段排除非法证据的探讨,应关注的主要问题包括:审前阶段排除非法证据的重点环节、排除非法证据的启动与证明和排除非法证据的范围。

| Abstract: | The procuratorial organ in China has the unique attribute of the power of criminal proceedings diversification and full participation. It, therefore, can and should play a greater role in the specific application of the exclusionary rule in the pretrial stage. The main problems involved in discussing procuratorial organs＇ exclusion of illegal evidence in the pretrial stage are： the key stage, the start and proof, and the range for the exclusion. |
