| 摘 要： | 地上权是用益物权的一种,肇始于罗马法,并为大陆法系国家民法所继承。罗马法的地上权制度仅仅是现代民法地上权制度的一个雏形。但是,它对后世民法关于用益物权的立法,在观念和技术上产生的巨大影响却是深远的,值得我国在设计相应土地用益物权制度时加以借鉴。

| Abstract: | As one of usufruct, superficies originated from Roman law, was carried down through national civil law of the Continental law family. The superficies of Roman law was just embryonic form of modern one. But it left great influence on later legislation, ideas and technology of usufruct in civil law; and is worth learning from while China designing corresponding systems of land usufruct. |
