| 摘 要： | 西塞罗以其丰富的实践经验和深厚的哲学素养造就了其思想兼具理想主义和现实主义二重性,并一直试图寻求二者的平衡。他关于自然法和正义的观念体现了超越现实的追求,而对国家和法律功能的解释又反映了其功利主义的一面。西塞罗的《论共和国论法律》及其思想对西方各个时期的法律发展均产生过深刻的影响。

| Abstract: | Cicero's rich experience practice and deep philosophy attainment brought up both idealism and realism in his thoughts, and he had tried to keep a sort of balance between them. The concept of the natural law and justice embodies his pursuit. The explain of the function of the nation and law reflects the utilitarianism. Cicero mixed the Greece culture and Roma spirit together. DE RE PUBLICA DE LEGIBUS has exerted a profound influence in every period of legal development of the West. |
