| 摘 要： | 遵守公共秩序是我国宪法规定的公民的基本义务,而公民维护公共秩序的法律地位长期以来在法律上未予明确,这与社会主义法治建设和社会主义精神文明建设的要求并不相符。在新时期,像劳动权、受教育权一样,维护公共秩序应当既是公民的基本权利,也是公民的基本义务。

| Abstract: | Obeying the public order is the fundamental duty of the citizen required by the constitution. However the citizen's legal position of safeguarding the public order has not been clearly prescribed by the constitution for a long time. This is not consistent to the construction of socialist rule of law and the construction of socialist cultural and ethieal progress. Safeguarding the public order at the new stage is a fundamental right and duty of the citizen, just as the right of labor and education. |
